Privacy Policy

This Privacy Policy explains how LUIS LAZARO LEO (hereinafter, "we" or "Modernetdigital.cat") processes your personal data when you use the website modernetdigital.cat, contact us, or subscribe to our content.

1. Data Controller

The processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

2. Data we may process

  • Identification and contact data (name, surname, e-mail, city or province if provided).
  • Browsing data (IP, device, browser, pages visited, session time), obtained through cookies or similar technologies, according to our Cookie Policy.
  • Subscription and communications (newsletter preferences, opens/clicks).
  • Editorial interaction (comments, forms, participation in contests or surveys).
  • Commercial relationships (if you contract advertising or collaborations).
  • Images you voluntarily send us (e.g., for participation or events).

3. Purposes and legal bases

  • Subscription and management of accounts/newsletters — Perform the contractual relationship or pre-contractual measures (art. 6.1.b GDPR).
  • Sending editorial and/or commercial communications (newsletters, alerts, promotions) — Consent (art. 6.1.a) and, if you are already a reader/client, legitimate interest and art. 21.2 LSSI (option to object in each send).
  • Handling requests (contact, press, incidents) — Perform the relationship or legitimate interest in assisting you (art. 6.1.b/f).
  • Website analytics and improvement — Consent (analytical cookies) and legitimate interest in security and maintenance (art. 6.1.a/f).
  • Programmatic advertising — Consent for advertising cookies and, where applicable, legitimate interest for strictly necessary measures (art. 6.1.a/f).
  • Compliance with legal obligations — (e.g., tax, rights handling) art. 6.1.c GDPR.

4. Data retention

  • Communications and subscriptions: while you maintain consent or the relationship; afterwards, legal blocking during applicable limitation periods.
  • Contact/incidents: until the request is resolved and during legal retention periods.
  • Browsing data/cookies: as indicated in the Cookie Policy.
  • Billing/commercial relationships: up to 6 years (commercial/accounting regulations), if applicable.

5. Recipients and processors

We do not sell your data. We may share them with:

  • Technology providers (hosting, maintenance, e-mailing, analytics, programmatic), who act as data processors following instructions and with data processing agreements.
  • Public entities or authorities when there is a legal obligation.

6. International transfers

If some providers are outside the EEA, we will ensure an adequate level of protection through a adequacy decision (e.g., EU–US Data Privacy Framework) or, if not applicable, standard contractual clauses and additional measures (arts. 45–46 GDPR).

7. Rights of data subjects

You may exercise the rights of access, rectification, erasure, objection, restriction, and portability, as well as withdraw consent at any time.

How to exercise them: send an email to modernetdigital@gmail.com indicating the subject “Data protection rights”, attaching a document proving your identity. We respond within one month (extendable by two months in complex cases).

If you consider that we have not properly addressed your request, you have the right to file a complaint with the Spanish Data Protection Agency (AEPD) through its electronic office.

8. Commercial communications

You can unsubscribe at any time through the unsubscribe link included in the mailings or by writing to modernetdigital@gmail.com.

9. Minors

We do not collect data from minors under 14 years without the consent of the parent or legal guardian. If we detect registrations without such consent, we will diligently delete them.

10. Security

We apply appropriate technical and organizational measures (access control, encryption in transit, minimum access policies) to protect data against unauthorized access, loss, or destruction.
